Bulk Email Usage Policy

The following agreement is in addition to our Acceptable Usage Policy specific to Bulk Email subcribers, between 123media and Bulk Email customer(s).

WHEREAS, 123media is an information provider, offering data storage and transfer services over the Internet, through web servers;

WHEREAS, Bulk Email customer is a person or organisation who is engaging in utilising the Bulk Email products through 123media;

In consideration of the mutual promises contained herein, the parties agree as follows;

1) Monthly Customer – Credits policy
Email credits will automatically be renewed on the 1st day of every month. All remaining credits that have not been used during the current month, will expire each month as the new credits renew. As 123media rely on rented servers for email campaigns and services, 123media cannot refund any customer should the services not be used during the month. Monthly fees are payable in full by the 1st of every month regardles of whether the services will be used during that month or not.

2) Opt-in only lists
Each recipient must have provided verifiably granted intentional permission to receive mailings by either:
Written or email evidence.
Electronic evidence such as a time and date stamp and IP address.

The inability to supply adequate evidence of an opt-in mailing list may result in immediate account suspension.

3) Anti-Spam
Unsolicited bulk email (also known as spam) or Unsolicited commercial email (UCE) as per our Acceptable Usage Policy is strictly prohibited. Any Bulk Email customer engaged in the following actions will face immediate suspension.
Using our Bulk Email facility to send either UCB or UCE.
Any attempt to manipulate the Web Links appended automatically to the footer of each outgoing message by 123media.
Any account found to be utilising any misleading, false content, or attempting to distribute illegal information will be immediately suspended and reported to the appropriate authorities.
